Confidentiality of Student Records and Federal Education Rights and Privacy Act (FERPA) -- Pending

BYU-Pathway Worldwide is sponsored by The Church of Jesus Christ of Latter-day Saints. The personal data of all students served by BYU-Pathway Worldwide is managed in accordance with the Privacy Notice – BYU-Pathway Worldwide (Updated 2024-03-01), and the Church’s Global Privacy Notice. When students matriculate in BYU-Idaho or Ensign College online programs supported by BYU-Pathway, their personal data is also managed in accordance with the Privacy Notices of BYU-Idaho or Ensign College, respectively.

FERPA

Students matriculated in BYU-Idaho and Ensign College online degree programs, supported by BYU-Pathway Worldwide, also have rights under The Family Educational Rights and Privacy Act (FERPA). FERPA is the primary law that regulates access to student education records (as defined in 34 C.F.R. § 99.3) at colleges and universities receiving financial assistance from the federal government of the United States. BYU-Pathway Worldwide complies with Federal Education Rights and Privacy Act (FERPA) to the extent it provides services to students enrolled in online programs of BYU–Idaho and Ensign College (Covered Students).

The Family Educational Rights and Privacy Act (FERPA) affords students enrolled in BYU-Idaho and Ensign College online degree programs, supported by BYU-Pathway Worldwide, certain rights with respect to their education records. These rights include:

• The right to inspect and review the student’s education records within 45 days after BYU-Pathway receives a valid request for access. Students can request access to their education records by contacting BYU-Pathway Support in writing at support@byupathway.org. To protect your records, the college will verify the student’s identity through questions that are unique to the student before allowing access. BYU-Pathway will arrange a time and manner for the student to inspect his or her record with the Registrar (or the Registrar’s representative)

• The right to request amending those education records that the student believes are inaccurate or misleading. Students can request that their education records be amended if they believe they are inaccurate or misleading, or a violation of their privacy rights. Students can request such a change by contacting BYU-Pathway Support in writing at support@byupathway.org, clearly identifying the part of the record they want changed and specifying why it is inaccurate or misleading. If a decision is made not to amend the record as requested by the student, the student will be notified of the decision and be advised of his or her right to a hearing regarding the request for amendment. Additional information regarding the hearing procedures will be provided to the student when notified of the right to a hearing. The right to amend under FERPA does not apply to grade changes. • The right to consent to disclosure of personally identifiable information contained in the student’s education records, except to the extent that FERPA authorizes disclosure without consent. One exception that permits disclosure without consent is disclosure to school officials with legitimate educational interests. A school official is a person employed by BYU-Pathway Worldwide, BYU-Idaho, or Ensign College in an administrative, supervisory, academic, research, or support staff position; a person or company with whom BYU-Pathway, BYU-Idaho, or Ensign College has contracted (such as an attorney, auditor, or collection agent); the Board of Trustees or its agents; a student serving on an official committee, such as a disciplinary or grievance committee; or a student assisting another institution official in performing his or her tasks; a person employed by, under contract to, or designated by the university to perform a specific task. An school official has a legitimate educational interest if the official:

o is performing a task that is specified in his or her position description or by contract agreement;

o performing a task related to a student’s education;

o performing a task related to student discipline;

o performing a service or benefit relating to the student or the student’s family, such as health care, counseling, job placement or financial aid.

BYU-Pathway Worldwide, BYU-Idaho, or Ensign College may also disclose a student’s education records without consent to officials of another college or university to which the student seeks or intends to enroll, or to a school in which the student is currently enrolled.

• The right to file a complaint with the U.S. Department of Education concerning alleged failures by BYU-Pathway Worldwide, BYU-Idaho, or Ensign College to comply with the requirements of FERPA. To file a complaint, write to: Family Policy Compliance Office, U.S. Department of Education, Student Privacy Policy Office, 400 Maryland Ave, SW, Washington, D.C. 20202-8520.

• The following information is considered to be public or directory information and may be released without prior student consent. Please note that, although this information is considered releasable to third parties, disclosure is not required. BYU-Pathway Worldwide, BYU-Idaho, and Ensign College have established procedures for scrutinizing requests from and releasing information to any third party.

o Student name

o Home and local address

o Telephone numbers

o E-mail addresses

o Photograph

o Major field of study

o Degrees and awards received

o Previous educational institutions attended

o Dates of attendance (current and past)

o Enrollments in previous, current, and future terms

o Class standing (freshman, sophomore, etc.)

o Total hours earned

o Enrollment status (full-time, part-time, less than half time)

o Expected date of graduation

o Deferred registration eligibility

o Student ID (applicable only for Ensign College on-campus students)

• Students have the right to block the release of their public directory information or may modify the display of their public directory information. This can be done through the student’s “Update Privacy Settings” tab after they log in to byupathway.org. For complete confidentiality, these changes must be completed within the first five days of each semester or term.
